Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the third respondent to give permission and 1, 2, 4 respondent to give police protection to demolish the petitioner building property consisting of 120 sq.m in Survey No.596/18 at Appanallur Village, Thottiyam Taluk, Trichy District within the time frame fixed by this Court. ORDER
Heard the learned counsel appearing for the writ petitioner, the learned Special Government Pleader appearing for the third respondent and the learned Government Advocate (Criminal Side) appearing for the respondents 1, 2 and 4. Considering the nature of relief to be granted, issuance of notice to the fifth respondent is dispensed with. 2/4
2.The petitioner wants this Court to direct the official respondents to give him Police protection to demolish the petition mentioned building. Though the revenue records indicate that the petitioner's title over the petition mentioned survey number is accepted by the authorities, the fifth respondent is said to be in possession of the said premises. The fifth respondent is probably an encroacher or a trespasser. If the petitioner wants to get back his property, he must institute appropriate proceedings against the fifth respondent. The writ petitioner cannot short circuit the process by seeking demolition of the building with the blessing of the official respondents.
3.Granting liberty to the writ petitioner to workout his remedy in the manner known to law, this Writ Petition is disposed of. No costs. 19.09.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No MGA 3/4
