For Respondent : Mr.K.Sanjai Gandhi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 379 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 4(1-A) of Tamil Nadu Prohibition Act, in Crime No.379 of 2022 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that when the respondent police were in patrol duty A1 was illegally found in possession of 18 liquor bottles (each contains 180 ml), when he was arrested, he has confessed that the petitioner herein / A2 bought 9 liquor bottles and thereafter, removed the label and seal and then he mixed some tablets and added water and thereby, he converted the 9 liquor bottles into 18 liquor bottles and handed over the same to A1 and asked him to sell it. Hence, the case.

CRL OP(MD). No.22817 of 2022 3.The learned Counsel for the Petitioner would submit that the Petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and thereby, seeks anticipatory bail. 4.The learned Government Advocate (Crl. Side) would submit that the petitioner is having 11 previous cases of similar nature and the investigation of the case is pending and hence, he strongly opposes to grant anticipatory bail to the petitioners.

5. Taking into consideration of the facts and circumstances of the case and that the petitioner is having 11 previous cases in similar nature and that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
