To Condone the delay of 87 days in filing the application to set aside the abatement caused due to the death of N.Dhanabal, the 1st respondent in the above Second Appeal. https://www.mhc.tn.gov.in/judis

ORDER

These Civil Miscellaneous Petitions are filed to condone the delay of 87 days in filing the application to set aside the abatement caused due to the death of N.Dhanabal / the 1st respondent and to implead his legal heirs in the above Second Appeal. 2.The learned counsel appearing for the respondents 1 and 3 submitted that he has received instructions to represent the respondents 6 and 7.

However, this Court, vide order dated 08.01.2026, has appointed M/s.Mukila, (Enrol.No.5473/2025, Mobile No.93612 12932) as Legal Aid Counsel for the sixth respondent and M/s.M.Sangeetha, (Enrol.No.9521 /2022, Mobile No.82206 60916) as Legal Aid Counsel for the seventh respondent to assist the Court. The said Legal aid counsels shall continue in this case for representing R6 and R7.

4. The High Court Legal Services Committee attached to this Bench shall pay a sum of Rs.5,000/- each to the said legal aid Counsels for the respondents 6 and 7 towards remuneration within a period of two weeks from the date of receipt of a copy of this order. 5.Being satisfied with the reasons stated in the accompanying affidavits filed in support of these petitions, this Court is inclined to allow these petitions. 6.Accordingly, these Civil Miscellaneous Petitions are allowed and the delay of 87 days in filing the application to set aside the abatement caused due to the death of N.Dhanabal/1st respondent, is condoned. Registry is directed to carryout the necessary amendment in the main appeal.
