Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to forbear the Respondent No. 4 from registering the sale deed or any other kind of instruments in respect of plots made in the unapproved lay-outs formed by the Respondent Nos.5 to 9, their agent and other, comprised in Survey Nos. 186/4 and 186/4A which is situated at Melur Taluk, Madurai District in accordance with sections 34 and 35 of the Registration Act, 1908 and read with Rules 55 and 162-A made there under.

ORDER

Heard the learned Counsel for the petitioner and the learned Additional Government Pleader for the official respondents. 2.Issuance of notice to the private respondents is dispensed with. 3.The petitioner wants this Court to restrain the registering authority from registering any document in respect of the petition mentioned lands. 4.It is not in dispute that the petitioner had already filed a suit in O.S.No.209 of 2021, on the file of the District Munsif Court, Melur against the private respondents herein. The petitioner has also filed an application in I.A.No.8 of 2025 seeking interim relief.

5.The Trial Court (District Munsif Court, Melur) is directed to dispose of the said interlocutory application on merits and in accordance with law after putting the respondents therein on notice, within a period of eight weeks from the date of receipt of a copy of this order. 3/6

6.With the above direction, the writ petition stands disposed of. No costs.

7.Registry is directed to mark a copy to the District Munsif Court, Melur.
