Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 274 of 2023 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner / accused apprehending arrest at the hands of the respondent police for the offences punishable under sections 328 IPC and Section 24(1), 6(a) of the Cigarette and Other Tobacco Products Act, 2003 in Crime No.274 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2. The case of the prosecution is that the petitioner herein and other accused have illegally found in possession of 168 kgs of Tobacco produces worth about Rs.1,45,000/-. Hence, the complaint.

3. The leaned counsel appearing for the petitioners would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and hence, he seeks anticipatory bail.

4. The learned Additional Public Prosecutor would submit that A1 is still in custody and the contraband recovered is 168 kgs of Tobacco products. Hence, he strongly, opposed to grant anticipatory bail to the petitioner.

5. Considering the serious nature of offence committed by the petitioner and also submission made by the learned Additional Public Prosecutor appearing for the respondent, this Court is not inclined to grant anticipatory bail to the petitioner.
