PRAYER :- For Bail in Crime No.265 of 2023 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner/accused herein, who was arrested on 06.03.2023 for the alleged 1/3

offence under Sections 8(c), 20(b)(ii)(C), 29(1), 25 of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.265 of 2023, on the file of the respondent police, seeks bail.

2. An earlier application was dismissed by this Court, by the order dated 27.09.2023 in Crl.O.P(MD) No.17384 of 2023, it is submitted by the learned Additional Public Prosecutor that the petitioner has been detained under Act 14, as Drug Offender, by order dated 04.07.2023. On that ground, it was dismissed with liberty to revive the application at the appropriate time. This petition has been filed on the ground that proceedings under Act 14 invoked against the petitioner is set aside in HCP(MD) No.1039 of 2023, dated 30.10.2023.

3. The learned Additional Public Prosecutor would submit that Final Report was filed and it was taken cognizance before the concerned trial Court.

4. Since the Final Report was filed before the concerned trial Court, let the petitioner file a bail application before the concerned trial Court itself, without reference to this Court repeatedly.
