Heard Mr.T.M.Madasamy, learned counsel for the petitioner and Mr.J.K.Jayaselan, learned Government Advocate for the respondents 1 and 2.

The Writ Petition has been filed praying for a Mandamus, directing the second respondent to cancel the registration made to the respondents 3 and 4 with respect to the vehicles bearing registration numbers TN05AA8426 (LMV Motor Car) and TN01AJ2526 (LMV Motor Car) respectively based on the petitioner's representations dated 12.09.2024 and 03.10.2024.

3. In view of the limited relief prayed for and proposed to be granted in the light of facts brought to the notice of this Court, notice to the respondents 3 and 4 is dispensed with.

The learned counsel for the petitioner would submit that the petitioner has also made representation to the second respondent for cancellation of registration certificate standing in the name of the respondents 3 and 4. Since the said representation has not been considered, I am of the view that it would be suffice to dispose of the Writ Petition by directing the second respondent to consider the representation of the petitioner dated 12.09.2024.

5. At this juncture, the learned Government Advocate appearing for the respondents 1 and 2, would submit that the petitioner had not produced any proof of acknowledgment of the representation.

Considering the submissions made on either side, I am of the view that the petitioner may submit a fresh representation to the second respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the second respondent shall consider and pass orders, on merits and in accordance with law, after affording a reasonable opportunity of hearing to the petitioner and respondents 3 and 4, within a period of six weeks therefrom.

7. With the above direction, this Writ Petition is disposed of. No costs.
