ORDER : The Court made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147,148,342,324,302 of IPC in Crime No.266 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that due to previous enmity on 08.07.2023 while there was a temple dispute all the accused persons came there and at that time there was a wordy quarrel in which the accused person attacked the son of the defacto complainant with knife and caused his death,hence the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that on the date of occurrence the petitioner was not present in the scene of occurrence hence he seeks anticipatory to the petitioner. 4.The learned Additional Public Prosecutor would submit that all the accused persons due to previous enmity brutally attacked the defacto complainant and his son and also caused death of the son of the defacto complainant. He would further submit that specific allegation has been levelled as against this petitioner, hence he objected to grant anticipatory bail to the petitioner.

5. It is seen that there is a specific allegation as against the petitioner that he caught hold of the deceased and other accused stabbed on the neck of the deceased. Taking into consideration the facts and circumstances of the case and also taking into consideration the gravity of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3

6. Hence the petition stands dismissed.
