This writ petition has been filed for a writ of Certiorarified Mandamus, to call for the records pertaining to the impugned proceedings in No.OFT/6601/ LO/DR and P/2025/01 dated 21.08.2025 issued by the respondent and quash the same on the ground that the same is arbitrary, illegal and without any legal basis and consequently directing the respondent to disburse the death-cum-terminal benefits and pensionary benefits of the Petitioner's husband namely Late D.Senthilkumar, who was worked as Licenced Fireman (LFM) to the Petitioner, based on the Petitioner's representation dated 25.08.2025 within time frame that may be stipulated by this Court.

2. The claim of the petitioner is that she had married the deceased employee after the death of his first wife, which had happened in the year 2022. However, the deceased employee had not upgraded his Service Records. Hence, the petitioner had submitted a representation to the respondent to grant her the terminal benefits. The same had been rejected 2/5

by the respondent indicating that the petitioner's name has not been found anywhere in the Service Records of the deceased employee, without considering her claim that she was the legally wedded wife of the deceased.

In such view of the matter, the impugned order is set aside and the matter is remitted back to the respondent to consider the claim of the petitioner on merits and in accordance with law, if the petitioner satisfies that there has been a valid marriage between the petitioner and the deceased employee. Such exercise shall be completed by the respondent within a period of 16 weeks from the date of receipt of a copy of this order.

4. The writ petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed. 19.11.2025 NCC:yes/no Index:yes/no Internet:yes/no 3/5
