O R D E R

The petitioner asserts that his father was the absolute owner of land in survey No.315/5 and that a part of the house built on the said land falls within Natham Poramboku land in survey No.315/25. On the ground that the petitioner and his family have been in continuous possession and enjoyment of the said property for the past 30 years, the petitioner had submitted a representation seeking cancellation of the patta issued in favour of the third respondent. The present Writ Petition relates thereto.

2. Learned Speical Government Pleader accepts notice for respondents 1 and 2. He submits that the petitioner had made a representation directly to the District Revenue Officer and that such representation has been forwarded to the Revenue Divisional Officer for consideration. He submits further that an order would be issued on merits after providing a reasonable opportunity to the petitioner and the pattadar.

3.In view of the above submissions of learned Special Government Pleader, it is unnecessary to issue notice to the private respondent in this Writ Petition. Instead, without making any observations on the merits, this Writ Petition is disposed of by directing the first respondent to consider and dispose of the petitioner's request for cancellation of patta within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and the third respondent. No costs.
