ORDER : The Court made the following order :- The petitioner / Accused No.1, who was arrested and remanded to judicial custody on 23.10.2024 for the alleged offence under Sections 7, 8, 9(m) and 10 of POCSO Act, 2012 and Section 296(b) of BNS, 2023, in Crime No.28 of 2024, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the victim girls, who are aged 12 years and 8 years respectively, are the neighbours of the petitioner. The accusation against the petitioner is that he was compulsively causing sexual torture to the victim girls. The petitioner is a man aged about 62 years.
3. The learned Additional Public Prosecutor (Criminal Side), by relying upon Section 164 of Cr.P.C. / 183 of BNSS statements recorded from the victim girls, submitted that the petitioner was repeatedly targeting the victim girls and was attempting to sexually abuse them. He further submitted that the investigation has been completed and the draft police report is also ready.
4. Taking into consideration the facts and circumstances of the case and the 2/4
nature of allegations made against the petitioner who seems to have the proclivity to sexually abuse the victim girls, this Court is not inclined to enlarge the petitioner on bail at this stage. The police report shall be filed immediately and the same shall be taken cognizance and after the victim girls are examined in Court as witnesses, the petitioner can revive his claim for being enlarged on bail. Till then, this Court is not inclined to enlarge the petitioner on bail. It will adversely affect the interest of the victim girls who are none other than the neighbours of the petitioner.
