PRAYER :- To release the Petitioners/Accused No.1 bail in Cr.No.5 of 2022 in CC.No.447 of 2022.

ORDER : The Court made the following order :- The petitioner/Accused No.1, who was arrested and remanded to judicial custody on 21.12.2021 for the offences punishable under Sections 8(c), 22(c), 20(c) 1/3

and 29(1) NDPS Act, 1985, in Crime No.5 of 2022 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner and other accused were found in illegal possession of 21.720 Kg of heroin. Hence, the complaint.

3. When the matter is taken up for hearing today, the learned Additional Public Prosecutor represented that in this case all the prosecution witnesses have been examined and the case stands posted for questioning under Section 313(1)(b) of Cr.P.C.

4. In view of the fact that the case stands posted for questioning under Section 313(1)(b) of Cr.P.C and the seized contraband in the commercial quantity, this Court is not inclined to grant bail to the petitioner.

5. Hence the petition stands dismissed.
