ORDER

This Petition has been filed to quash the F.I.R in Crime No. 115 of 2023 on the file of the first respondent police. 1/4

The crux of the case is that the defacto complainant / second respondent, who is the husband of the petitioner, stating that they had some dispute in their matrimonial life especially for a child, for that petitioner consuming some tablets and urge her husband, the defacto complaint to consume the same. Having dispute over this, he footed towards the Family Court, Trichy, seeking a relief in I.D.O.P. No.13/2018 and the petition was also withdrawn by the defacto complainant. In order to escape from the torture of medicine, the defacto complainant started to stay in the Poondi Madha Church at night and started to working in day time at his shop which is at No.1 Tollgate and never turned up to home. In these circumstances, on 23.05.2023, at about 09.10 p.

m, the petitioner gone to enter into the above said shop and she pushed away the Photocopier machine at time and tried to took the photocopier machine, suddenly, she attacked him with computer monitor in his back side and scratch him with her nails and bites a finger in his left hand and he sustained blood injuries and second respondent lodged a complaint that the petitioner has threatened to kill the second respondent by slicing him. Hence, the case was registered.

3. Heard the learned counsel on either side and perused the materials available on record.

4. On perusal of the records, this Court satisfy with the ingredients of the offence and the same is required to be investigated by the police officer. Hence, this Criminal Original Petition is dismissed. The petitioner is at liberty to file a petition, after filing final report, if so advised.
