ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 379 IPC in Crime No.313 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2. The case of the prosecution is that the petitioner herein and other accused have stolen 17 goats of the defacto complainant. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and hence, prays to grant anticipatory bail.

4. The learned Government Advocate (Crl. side) appearing for the respondent would submit that the petitioner herein is arrayed as A8 and the petitioner herein and other accused have stolen 17 goats of the defacto complainant and the property was recovered. He would further submit that the investigation of the case is pending and hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the serious nature of allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
