PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to call for the records relating to the summons issued by the 1st respondent u/s 160 and 91 of code of criminal procedure issued on 25.10.2023 and quash the same and pass such further or other orders.

ORDER

This petition has been filed seeking quashment of the the summons issued by the 1st respondent u/s 160 and 91 of code of criminal procedure issued on 25.10.2023.

2.Seeking order to set aside the summon issued by the first respondent in connection with the complaint given by the second respondent, this petition has been filed, summon cannot be quashed. On the basis of the complaint lodged by the second respondent against her husband and this petitioner, summon was issued to them by the first respondent for enquiry. It is submitted that the petitioner is aged about 75 years and residing in Chennai.

3.Considering the fact that the petitioner is the mother of the husband of the complainant and also considering the fact that the petitioner's Advocate has given undertaking that the husband of the second respondent will appear before the first respondent for the purpose of completing the enquiry, if any particulars are required, so far this petitioner is concerned, she may be permitted to appear through Video 2/4

conference before the first respondent, since she is aged about 75 years and residing in Chennai and the Enquiry Officer is located in Madurai. The Enquiry Officer shall complete the enquiry on hearing both sides and hearing the petitioner through video conference. 4.With the above said directions, this criminal original petition stands disposed of. Consequently, connected miscellaneous petition is closed.
