ORDER

Heard both sides.

2.The writ petitioner's husband was a farmer. On 22.05.2025, at about 08.30 am, when he was going to his field, he stepped on a live electric wire that had snapped and died on the spot due to electrocution. In this regard, Crime No.110 of 2025 was registered under Section 194 of BNSS Act, 2023. The petitioner seeks compensation to the tune of Rs.30,00,000/-.

3.It has been held by the Hon'ble Supreme Court in more than one case that to adjudicate disputed facts, the claimant has to move the 2/6

jurisdictional Civil Court. However, TANGEDCO issued Board Proceedings No.11 dated 21.12.2024 providing for payment of compensation to the tune of Rs.10,00,000/- in a case of fatal electrical accidents when the victims come into contact with snapped conductor and live wire from the overhead lines. The case on hand falls under the said category. I, therefore, direct the second respondent to pay a sum of Rs.8,50,000/- to the writ petitioner for herself and for her daughter and minor son and a sum of Rs.1,50,000/- to the mother of the deceased. This shall be done within a period of eight weeks from the date of receipt of a copy of this order. It is open to the writ petitioner to move the jurisdictional Civil Court for enhanced compensation. 4.This writ petition is allowed accordingly.
