Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari to call for the impugned charge memo dated 26.09.2024 under reference Na.Ka.No.A3/2727/2024 issued by the second respondent to the petitioner and subsequently set aside the same as illegal, arbitrary and erroneous forthwith.

O R D E R

Challenging the impugned charge memo dated 26.09.2024 under reference Na.Ka.No.A3/2727/2024 issued by the second respondent to the petitioner, the above writ petition has been filed.

2. It is the contention of the petitioner that he is facing a criminal case and he was also issued with a charge memo. Since identical charges have been levelled in the charge memo, the petitioner has approached this Court stating that if the charge memo is allowed to proceed pending the criminal proceedings, it would adversely affect the criminal case.

3. When this writ petition came up for hearing, the learned Special Government Pleader appearing for the respondents, on instructions, submits that the criminal case has already ended in conviction.

4. In view of the same, this Writ Petition is dismissed. The petitioner is at liberty to raise the grounds raised in this petition before the Enquiry Officer. The enquiry shall be concluded within a period of six months from the date of receipt of a copy of this order. No costs. Consequently, connected Miscellaneous Petition is closed.
