ORDER : The Court made the following order :- This is the second anticipatory bail application. The petitioner/Accused No.3, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 379 of I.P.C. r/w Section 21(v) of TNMMDR Act, in Crime No.236 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 21.09.2023 at about 05.00 p.m., on receiving secret information the defacto complainant went to the occurrence spot. At that time, they found the petitioner was involved in illegal transportation of gravel sand from Poramboke land. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.

4. The learned Additional Public Prosecutor (Crl.side) would submit that the earlier application of the petitioner was dismissed by stating that this petitioner is having five previous cases, out of which, two cases are similar in nature. There is no change in circumstances.

5. Considering the submission of the learned Additional Public Prosecutor (Crl.side) that there is no change in circumstances, this Court is not inclined to grant relief to the petitioner herein.
