ORDER

This Criminal Original Petition has been filed to direct the first respondent to direct the respondents 2 and 3 not to harass the petitioner by interfering in civil disputes, in the guise of enquiry by considering the petitioner's representation dated 20.11.2024.

The petitioner had send a representation on 20.11.2024 stating that the petitioner is the owner of the land comprised in Survey No.616/45 and 645A/2B, Chettinayakan Patti Village, Dindigul West Taluk, Dindigul District. There was boundary dispute between the petitioner and the fourth respondent herein. The petitioner made an application to conduct enquiry but no action was taken by the revenue and survey department. Thereafter, the petitioner had filed W.P(MD)No.6740 of 2024 seeking direction to conduct survey and demarcation of the boundary which was allowed, against which the fourth respondent filed a recall petition in W.P(MD)No.10485 of 2024 and the same was also withdrawn.

3. The fourth respondent is a highly influential person having support with both Police and politician. The fourth respondent is 2/4

attempting to give a criminal colour by disputing boundary and to create law and order problem and thereby restraining the petitioner from enjoying his property, having no other way the petitioner sent a representation to the Police officials. But no action has been taken. Hence, the present writ petition.

4. Mr.A.Thiruvadi Kumar, learned Additional Public Prosecutor submits that the petitioner's complaint to the Superintendent of Police was forwarded to the respondent Police who had caused an enquiry. During enquiry it was found that the fourth respondent had earlier lodged a complaint and CSR No.530 of 2024 was assigned and after enquiry CSR No.530 of 2024 has been closed on 18.11.2024. For the purpose of earlier enquiry the petitioner was called and now the petitioner is not required. The petitioner's complaint is also closed. The respondent Police shall provide Police protection to Revenue and Survey authorities if such request is received.
