ORDER

The petitioners seek to quash the final report in C.C.No.232 of 2023 on the file of the Judicial Magistrate, Tiruchendur, Thoothukudi District, which was filed for the offences under Sections 294(b), 323, 324 and 506(ii) I.P.C.

2. The allegation in the final report is that due to previous enmity, the petitioners abused the defacto complainant and his relative in filthy language and also attacked them with knife and thus, committed the aforesaid offence.

3. Admittedly, the petitioners and the respondents 2 and 3 belong to the same village and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated Nil February 2025 and the scanned copy of the compromise memo reads as follows:

4. The petitioners and the respondents 3 and 4 are present before this Court in person. They are identified by Mr.S.Kalaiselvan, Special Sub Inspector of Police, Aviyoor Police Station, Virudhunagar District. All the parties confirmed the compromise arrived at between them.

5. In view of the same and considering the nature of the offences and the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report in C.C.No.232 of 2023 on the file of the Judicial Magistrate, Tiruchendur, Thoothukudi District, is quashed and the Criminal Original Petition stands allowed. The petitioners shall pay a cost of Rs.5000/- (Rupees Five Thousand only) to the High Court Legal Services Authority attached to this Bench. 18.09.2025 NCC : Yes / No Index : Yes / No LS 6/8
