Prayer : Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for the records relating to the Impugned Charge Sheet in Spl.S.C.No.45 of 2025 on the file of the learned I Additional District and Sessions Court (PCR), Thanjavur and quash the same.

ORDER

This petition has been filed challenging the impugned Charge Sheet in Spl.S.C.No.45 of 2025 on the file of the learned I Additional District and Sessions Court (PCR), Thanjavur.

2. The allegation in the Final Report is that the petitioner trespassed into the School, where, the defacto complainant was working as Principal, abused him in filthy language and humiliated him on account of his caste and thus, committed the aforesaid offences.

3. The learned counsel for the petitioner would submit that the allegations made in the Final Report are false; that on account of an earlier civil dispute, the impugned complaint has been lodged; that none of the allegations would attract the offences as alleged; and that the petitioner has not trespassed into the School and he entered into the School only to fix a water tank on the request of one of the Teachers.

4. This Court is of the view that the points raised by the learned counsel for the petitioner cannot be adjudicated in the quash petition. If the complaint is motivated and is false, it have to be adjudicated only in a trial. Hence, this 2/4

Court is not inclined to quash the impugned proceedings. The petitioner is at liberty to raise all the points before the concerned trial Court.
