This criminal original petitioner to direct the first respondent to expedite the investigation and file a final report in crime no. 435/2011 on the file of 1st respondent in accordance with law. ORDER:- This Miscellaneous Petition filed to extend the time for further period of six months to complete the investigation and to file final report, coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.Ravi, Additional Public Prosecutor, on behalf of the Petitioner and of Thiru.M.Chandra Bose, Advocate for the respondent, this Court made the following order: 1/3
The Inspector of Police, CBCID, Madurai City has filed the above application seeking extension of time to complete the investigation and file a final report as directed by this Court in Crl.M.P.(MD)No.11141 of 2022 in Crl.M.P.(MD)No.3773 of 2022 in Crl.M.P.(MD)No.9257 of 2021 in Crl.O.P.(MD)No.6192 of 2021 dated 22.09.2022.
2. The learned counsel appearing for the first respondent would submit that this is the fifth time, the petitioner is approaching the Court for extension of time.
3. The learned Additional Public Prosecutor appearing for the petitioner would submit that after completing the investigation, the papers were forwarded to the Government for getting sanction and the same is pending before the competent authority and seeks three months further time to complete the investigation and file a final report.
4. At this juncture, the learned counsel appearing for the first respondent would submit that the case is pending from 2011 onwards and hence, time may be extended as finally.
5. Considering the fact and circumstances of the case, three months further time is extended finally from the date of receipt of a copy of this order.
6. Accordingly, this petition is ordered.
