ORDER : The Court made the following order :- The petitioners/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 and 427 of IPC in Crime No.188 of 2023, on the file of the respondent police, seek anticipatory bail.
2. Earlier when the matter was taken up for hearing, the respondent was directed to assess the damage caused to the building. Learned Additional Public Prosecutor submitted that inspite of repeated letters to the investigation officer, there is no response.
3. Because of the non co-operation of the investigation officer, this Court inclines to grant relief to the petitioners with a condition to deposit a sum of Rs.75,000/- (Rupees Seventy Five Thousand only) to the credit of the Crime No.188 of 2023 before the trial Court, without prejudice to his defence.
4. On such deposit, this Criminal Original Petition is allowed and the petitioners are ordered to be released on bail in the event of arrest or on their appearance, before the learned Judicial Magistrate, Thiruchuli, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners shall appear before the respondent police 2/4
daily at 10.30 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
5.
