Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents No.1 to 4 herein to cancel the electricity service connection in Door No. 1/37 existing in Survey No.646/6 situated at Kumarapettai, Sirukudalpatti Post, Thiruppathur Taluk, Sivagangai District, on the basis of the petitioner representation dated 11.05.2023.

ORDER
The petitioner challenges the proceedings issued by the official respondents sanctioning electricity service connection in favour of the 5th respondent.

2.The petitioner contends that the petitioner is the owner of the property in Door No.1/37 in Survey No.646/6 situated at Kumarapettai, Sirukudalpatti Post, Thiruppathur Taluk, Sivagangai District. The 5th respondent is in occupation of the said property as a tenant. The petitioner states that the 5th respondent in his application for supplying service connection has stated Door No.1/29A instead of Door No.1/37 and a suit in O.S.No.149 of 2022 on the file of the Sub Court, Sivagangai, was instituted against the 5th respondent for eviction.
3. Admittedly the 5th respondent is in occupation of the said property as a tenant and therefore, he is entitled for service connection. However, it is made clear that providing of service connection will not come in the way of the petitioner seeking eviction of the 5th respondent from the said property in the pending suit. The trial Court is directed to consider the suit filed by the petitioner strictly on the available materials and records. 3/6
4. With this observation, this writ petition stands disposed of. No Costs.
