ORDER
The petitioners seek to quash the final report in S.C.No.11 of 2023 on the file of the Special Court for Trial Cases under SC and ST Act (PCR Court) Thoothukudi, which was filed for the offences under Sections 341, 294(b) & 352 I.P.C and Sections 3(1)(r), 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
2. The allegation in the final report is that due to previous enmity, the petitioners abused the defacto complainant and her son by using their caste name and thus, committed the aforesaid offence.
3. Admittedly, the petitioners and the respondents 3 and 4 belong to the same village and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo on 17th September 2025 and the scanned copy of the compromise memo reads as follows:

4. The petitioners and the respondents 3 and 4 are present before this Court in person. They are identified by Mr.S.Kalaiselvan, Special Sub Inspector of Police, Aviyoor Police Station, Virudhunagar District. All the parties confirmed the compromise arrived at between them.

In view of the same and considering the nature of the offences and the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report in S.C.No.11 of 2023 on the file of the Special Court for Trial Cases under SC and ST Act (PCR Court) Thoothukudi, is quashed and the Criminal Original Petition stands allowed. The petitioners shall pay a cost of Rs.5000/- (Rupees Five Thousand only) to the High Court Legal Services Authority attached to this Bench.
6. It is reported that since the case was registered for the offences under Sections 3(1)(r), 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, the defacto complainant and the victim, who are present in Court, had each received Rs.90,000/-. Both 6/8
of them undertake to pay back the said amount to the credit of the District Collector of the concerned District within a period of three weeks. If the defacto complainant and the victim fail to make the payment within a period of three weeks, the order passed by this Court shall stand vacated without reference to this Court. 18.09.2025 NCC : Yes / No Index : Yes / No LS TO
