Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the 1st respondent in Na.Ka.Aa3/13048/2020 dated 27.10.2020 and quash the same as illegal and consequently direct the 1st respondent to conduct enquiry based upon the representations of the petitioner dated 13.12.2022.

Heard both sides.
2. During the pendency of this writ petition, the work of laying electric poles as well as drawing overhead lines have already been completed. However, the petitioner's counsel would state that the compensation has not been paid. 2/4

The first respondent is directed to finalise the issue and pass an appropriate order on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The petitioner is permitted to submit an application under Section 16 of The Indian Telegraph Act before the first respondent for determining and disbursal of compensation payable. Such an application shall be received and an enquiry shall be held and final order shall be passed on merits and in accordance with law within a period of eight weeks thereafter. If the petitioner is not happy with the quantum of compensation awarded, it is always open to the petitioner to move the jurisdictional civil Court for further enhancement. The petitioner can very well receive the determined compensation without prejudice to her right to seek enhanced compensation. This writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
