Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of certiorarified mandamus, to call for the records of the 1st respondent pertaining to the impugned order in Na.Ka.No. 7174/2023/Aa2, dated 13.03.2024, and quash the same as illegal and arbitrary and consequently direct the 1st respondent to delete the 2nd and 3rd respondents name in patta no.148 bearing in Survey No.18/1, 18/3 and 18/10 and the same property is situated at Ayyampalayam Village, Palani Taluk, Dindigul District, and issue separate Patta in petitioner's name only.

ORDER

Learned counsel for the petitioner submits that he has been instructed by his client that an appeal has already been preferred to the Revenue Divisional Officer against the order of the first respondent. Learned counsel, therefore, seeks permission of the Court to withdraw the Writ Petition, with liberty to prosecute the appeal before the Revenue Divisional Officer. He has also made an endorsement in the case bundle to that effect.

2. In view of the above submission and endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed, as withdrawn, with liberty as prayed for. No costs. Consequently, the connected W.M.P.(MD) Nos.24099 and 24100 of 2024 are closed. 28.11.2024 NCC :
