ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. R. Rajaraman, Advocate for the Petitioner and of Mr. P. Kottai Chamy, Government Advocate for the respondent, this Court made the following order: "This Miscellaneous Petition is filed to recall the order passed by this Court in Crl.OP(MD) No.9147 of 2024, dated 26.06.2024. 2.Crl.OP(MD)No.9147 of 2024 has been filed by this petitioner/A1 in CC.No.151/2024, on the file of the learned Judicial Magistrate, Paramakudi, seeking speedy disposal of the above case, which was filed before this Court, only in the year 2024.
3.Considering the manner in which, the petition has been filed sought for speedy disposal of the case of the year 2024, this Court, while disposing of the above Criminal Original Petition has imposed a cost of Rs.5,000/- on the petitioner. 4.The learned counsel for the petitioner submits that this petitioner has filed Crl.OP(MD) No.9147 of 2024 on the ground that the respondent police has filed the final report in the counter case, however, they have delayed the process of filing the final report on his complaint. The learned counsel further submits that the petitioner is a mechanic and and he is not in a position to pay the cost imposed by this Court.

5.Considering the submission made by the learned counsel for the petitioner, the order of cost imposed passed by this Court in Crl.OP(MD) No.9147 of 2024, dated 26.06.2024 is ordered to be recalled.
