Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned proceedings issued by the respondent vide O.Mu.A6/ 4716/2024 dated 29.08.2024 and quash the same as illegal and also direct the respondent to issue the Death Certificate in favour of the petitioner's grandmother death dated 20.02.1956.

ORDER
This writ petition has been filed challenging the order passed by the respondent, thereby refused the request made by the petitioner to register the
death of his grandmother, dated 20.02.1956.. 2.According to the learned Counsel appearing for the writ petitioner, the petitioner's grandmother died on 20.02.1956. However, her death was not registered at that juncture. After a period of 68 years, the petitioner made a request to register her mother's demise. It was rejected on the ground that the Registration of Births and Deaths Act, 1969 and the Tamil Nadu Registration of Births and Deaths Rules, 2000 came into force only after 1969. Admittedly, the death was happened before 1969 and as such, the respondent has rightly rejected the request made by the petitioner to register the petitioner's mother demise.
3.In view of the above, this Court finds no infirmity or illegality in the order passed by the respondent and this writ petition is devoid of merits and is liable to be dismissed. However, the petitioner is at liberty to approach the civil Court for appropriate relief by producing evidence to show that his mother died on 20.02.1956. Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is also closed. 28.11.2024 3/3 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR
