PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct the respondent No.2 to not to harass the petitioner in the guise of enquiry and to conduct the enquiry in the manner known.

ORDER

This petition has been filed seeking direction to the respondent No.2 to not to harass the petitioner in the guise of enquiry and to conduct the enquiry in the manner known.

2.When the matter is taken up for hearing, the learned Government Advocate (Crl. Side) would submit that on the basis of the complaint given by the third respondent enquiry is undertaken in C.NO. 517/DCB/TAN/D3. It is further submitted that the third respondent is the owner of the College. The allegations against the petitioner is that he along with Sujatha collected huge money from the students. Later did not remit the same in the College account. Total amount is Rs.28 lakhs. 3.Considering the gravity of the offence, there shall be a direction to the petitioner to appear before the respondent police and co-operate with them for enquiry. There is no question of harassment at this stage. Depending upon the out come of the enquiry, the respondent police shall take further action and the parties can workout their remedy through appropriate proceedings, if so aggrieved.

4.With the above said directions, this criminal original petition stands disposed of.
