ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the first respondent. Considering the nature of relief to be granted, issuance of notice to the second respondent is dispensed with.

2.The second respondent gave complaint dated 27.03.2023 under Section 77A of the Registration Act, 1908 impeaching the document standing in favour of the writ petitioner. Taking cognizance of the said complaint, the first respondent issued notice dated 05.05.2023. Before final order could be passed, Section 77A of the Registration Act, 1908 itself was struck down by the Hon'ble Division Bench of this Court in the decision reported in 2024 (4) CTC 769 (Kathirvel Vs Inspector General of Registration). Therefore, the impugned proceedings become bereft of jurisdiction.

3.The first respondent is directed to close the complaint lodged by the second respondent and intimate the same to the petitioner also. 2/4
