Heard the learned Counsel on either side.

2. The petitioner seeks issuance of badge license by the respondents. He had already submitted an application in this regard. The stand of the respondent is that the petitioner is already involed in two criminal cases. The learned Government Advocate would point out that if the petitioner is issued with badge license and he continues to indulge in illegal transportation of liquor, that would certainly be prejudicial to public interest.

Taking into account the objection lodged by the learned Government Advocate, I direct the petitioner to file an affidavit before the respondent, undertaking not to involve in any criminal case in future. If the said undertaking is breached, the license issued in favour of the writ petitioner will be liable to be cancelled. The petitioner undertakes to file such an affidavit. Subject to the fulfillment of the other usual formalities, the respondent is directed to issue badge license to the petitioner as prayed for. This exercise shall be done within a period of four (4) weeks from the date of receipt of a copy of this order. This writ petition stands allowed. There shall be no order as to costs.
