Respondent (In all cases) Common Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the Impugned Order of the respondent in Na.Ka.No. 8860/2017/A7 dated 23.08.2024 and quash the same and subsequently directing the respondent to repay the EMD amount of Rs. 5,00,000/- made by the petitioner.

ORDER

These writ petitions are filed for the following relief: "to call for the records pertaining to the Impugned Order of the respondent in Na.Ka.No. 8860/2017/A7 dated 23.08.2024 and quash the same and subsequently directing the respondent to repay the EMD amount of Rs.5,00,000/- made by the petitioner."

2. The impugned orders, dated 23.08.2024 have been passed without any show cause notice to the petitioners and without giving them an opportunity to submit their objections. The impugned order suffers from arbitrariness. The impugned order shall be treated as show cause notice. The petitioners shall submit their objections to the same within a period of two (2) weeks from the date of receipt of copy of this order and within a period of six (6) weeks therefrom, the respondent is directed to

consider the objections raised by the petitioners and pass orders, in accordance with law.

3. With the above directions, these Writ Petitions stand disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
