ORDER

Heard the learned Standing Counsel appearing for the respondents 1 and 2 and the learned Special Government Pleader appearing for the respondents 3 and 4.

2.The petitioner joined five year Law Degree Course in the year 2010. He completed the same in the year 2015. But he has not cleared seven papers. He cleared six of them in January 2022. He however failed in the subject of Environmental Law.

3.According to the petitioner, he attempted to apply through online for writing the supplementary examinations to be held on 04.12.2023. His case is that only on account of server problem, he could not pay the examination fees. As per notification issued by the University, the last date for payment is 14.12.2022. The notification provides for submission of application through 2/5

online by 16.12.2022. It is seen from the typed set of papers that on 16.12.2022, the petitioner had submitted their representation to various authorities. From this I can safely conclude that in spite of several attempts, on account of certain digital issues, he could not pay the examination fee through online.

4.The learned Standing Counsel appearing for the respondent University expresses his strong opposition for allowing the writ prayer. This was endorsed by the learned standing counsel appearing for the College. But, in the interest of justice the petitioner may be given relief. Today is 23.12.2022. The examination is to be held only on 04.01.2023. The petitioner is permitted to submit the application along with necessary fees in person to the third respondent. The third respondent will ensure that the petitioner is able to write supplementary examination on 04.01.2023.

5.This writ petition is allowed on these terms. There shall be no order as to costs.
