ORDER
The petitioner/Accused No5, who was arrested and remanded to judicial custody on 24.08.2025 for the offences punishable under Section 420 of I.P.C. in Crime No.345 of 2025, on the file of the respondent police, seeks bail. 1/4
2. The case of the prosecution is that the defacto complainant had handed over his two tractors to A-1 & A-2 for monthly rent of Rs.20,000/-but they failed to pay the rental amount and refused to return the vehicle and further stated that the vehicles were in the possession of A3 & A4 and they tried to sell them. Hence, this case.
3. Taking into consideration of the facts and circumstances of the case and also considering the period of incarceration suffered by the petitioner, this Court has already granted interim bail to the petitioner vide order, dated 18.09.2025.
4. The learned Counsel appearing for the petitioner submitted that the petitioner has already executed bond and sureties and submitted the same before the Trial Court, based on the earlier order, dated 18.09.2025. Further, the petitioner is complying with the conditions stated in the earlier order.
5. The learned Additional Public Prosecutor appearing for the respondent police submitted that A-1 already granted interim bail. 2/4
6. Therefore, this Court is inclined to grant bail to the petitioner. Hence, the earlier order, dated 18.09.2025, is made absolute. The sureties already submitted before the Trial Court shall hold good on further conditions that, a) the petitioner shall make a non refundable deposit of Rs.50,000/- (Rupees Three Thousand only) to the credit of the Headmaster, Masathiyar Cor. Higher Secondary School, Vaikkolkara Theru, Chinnakadai Veethi, South Gate, Madurai, Central Bank of India, South Gate Branch, Account No.P.T.A.FUND SB.1833321714, IFSC No.CBIN0281503, MICR Code: 625016004, without prejudice to his contentions and rights before the trial Court. On such deposit being made, the learned Judicial Magistrate shall accept the sureties furnished by the petitioner.
b) the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders;
c)the petitioner shall not tamper with evidence or witness;
d)the petitioner shall not abscond during trial; 3/4
e)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
f) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
