ORDER : The Court made the following order :- The petitioner / Accused No.2, who apprehends arrest at the hands of the respondent Police, for the offence under Sections 147, 148, 149, 427, 294(B), 324, 307, 506(2), 302 of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in S.C.No.332 of 2023 on the file of the learned Sessions Judge, Mahila Court, Tirunelveli, seeks anticipatory bail.
2. The petitioner is arrayed as an accused person in S.C.No.332 of 2023 on the file of the learned Sessions Judge, Mahila Court, Tirunelveli, for the offence under Sections 147, 148, 149, 427, 294(B), 324, 307, 506(2), 302 of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002
3. The petitioner is absent during the trial in S.C.No.332 of 2023 on the file of the learned Sessions Judge, Mahila Court, Tirunelveli. Therefore non bailable warrant came to be issued on 05.11.2024.
4. The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates 2/4
without fail.
5. Considering the undertaking given by the petitioner, the petitioner is directed to appear before the learned Sessions Judge, Mahila Court, Tirunelveli, within a period of two weeks from the date of receipt of a copy of this order and file a petition to recall the NBW issued against him. The concerned Magistrate is directed to consider the same on merits and pass orders.
