PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to dispose of patta proceedings pending in Na.Ka.No.2/21254/2021 dated 29.07.2021 on the file of the 2nd respondent relating to survey No.495/23 situated at Sivankovil Sannathi Street, Munneerpallam Village, Palayamkottai Taluk, Tirunelveli District. ORDER
By relying on sale deed dated 17.12.1962 under which it is stated that the petitioner's father purchased 14 cents of land in S.No.495/23, and applying for patta in respect thereof, the present writ petition has been filed. 2.Learned Government Advocate accepts notice on behalf of all the respondents. By referring to communication at page No.28 of the typed set of papers, he submits that the total extent in S.No.495/23 is 47 acres and 85 cents. In view of the vast extent in the relevant survey number, he submits that an inquiry is ongoing. Once such inquiry is concluded to acertain the extent in the occupation of the petitioner, he states that the petitioner's request would be disposed of.
3.Accordingly, without making any observations on the merits, this writ petition is disposed of by directing the respondents to consider and dispose of the petitioner's request on merits after conducting the necessary inquiry within twelve weeks from the date of receipt of a copy of this order.
