Prayer:Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to take appropriate action forthwith based on petitioner's representation, dated 04.08.2022, as regards the illegality committed by the 4th respondent college while filling up of 32 non-teaching posts. O R D E R
This writ petition has been filed for a direction to the respondents 1 to 3 herein, to take appropriate action forthwith based on petitioner's representation, dated 04.08.2022, as regards the illegality committed by the 4th respondent college while filling up of 32 non-teaching posts.
2. The case of the petitioner is that the petitioner belongs to Hindu Adi Dravidar Community. He has passed 9th standard and failed in S.S.L.C and living below the poverty line. The fourth respondent college is a private aided college receiving 100% aid from the State Government. 2/6
While being so, the fourth respondent issued notification, dated 24.09.2021, calling for applications for filling up of 32 non-teaching posts under 12 categories. The petitioner applied for five categories and aspirant of getting appointment. The grievance of the petitioner is that the fourth respondent college committed malpractice in filling up of vacancies. Hence, he made a representation before the official respondents on 04.08.2022. Pursuant to which, the third respondent vide proceedings in O.Mu.No.9104/E1/2022, dated 24.08.2022, called for explanations from the fourth respondent. Thereafter, there is no progress. Hence, the petitioner has filed this writ petition with the aforesaid prayer.
3. The learned counsel appearing for the petitioner would submit that it would suffice, if the third respondent is directed to dispose of the representation of the petitioner, dated 24.08.2022, on merits and in accordance with law, within a specified period.
4. The learned Special Government appearing for the respondents, has no serious objection for such an order being passed by this Court. 3/6
5. Since no adverse order is going to be passed in this writ petition, notice to the fourth respondent is dispensed with.
6. Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the matter, directs the third respondent to consider the petitioner's representation, dated 04.08.2022 and pass appropriate orders, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above direction, this Writ Petition is disposed of. No costs.
