ORDER

The petitioner has sent a representation on 02.11.2024 making specific allegation against the third respondent/Bhavani, one Daisy and Ramar, who are attached to the second respondent police Station. The contention of the petitioner is that the second respondent on the guise of enquiry based on the complaint of the third respondent had called the petitioner and detained her in police station and using abusive words threatened her and had taken away the petitioner's bike and two signed cheque leaves and further directed the petitioner to settle the third respondent and her demands.

The learned Additional Public Prosecutor submitted that in this case, the third respondent had lodged a complaint against the petitioner alleging that the petitioner and the third respondent were in good terms earlier, at that time, the petitioner had taken away 10 sovereigns of gold jewels and Rs.4 lakhs in cash. When the third respondent demanded the same, the petitioner refused. Thereafter, she lodged complaint and on her complaint, CSR.NO.709 of 2024 registered and the petitioner was 2/5

called for enquiry. It is for the petitioner and the third respondent on their own had negotiated for settlement, now, which has been termed as harassment.

Considering the submission, finding that the petitioner had made a specific allegation against one Daisy and Ramar attached to the second respondent police, this Court finds that enquiry in CSR.NO.709 of 2024 as well as the complaint of the petitioner on 02.11.2024 to be conducted by the Deputy Superintendent of Police, Kanniyakumari and enquire both the petitioner and the counter-petitioner and conclude the same within two months from the date of receipt of a copy of this order.

4. With the above direction, this Criminal Original Petition is disposed of.
