Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the District Revenue Officer, Virudhunagar, the 2nd respondent herein to consider the application dated 05.07.2024 submitted by the petitioner in preference to the application submitted by the 5th respondent herein, for grant of prior approval of the site plans in order to obtain a Licence in Form LE-1 for manufacture of fire works under Rule 101/07 of the Explosive Rules, 2008 and pass orders, within the stipulated time. This Writ Petition is filed seeking a direction to the District Revenue Officer, Virudhunagar, the 2nd respondent herein to consider the application dated 05.07.2024 submitted by the petitioner in preference to the application submitted by the 5th respondent herein, for grant of prior approval of the site plans in order to obtain a Licence in Form LE-1 for manufacture of fire works under Rule 101/07 of the Explosive Rules, 2008 and pass orders, within the stipulated time. 2/6

It is the case of the petitioner that the petitioner intends to carry on business in the manufacture of fire works in the land in S.Nos. 1655/1 1671/2 and 1671/4 at Villuppanur Village, in the name and style of Sarguru Pyro Tech. Hence, the petitioner applied on 05.07.2024 for grant of license in Form LE-1 to manufacture fireworks and necessary fee has also been remitted to the second respondent. However, the same is pending on the ground of similar application by the 5th respondent in the same location. According to the petitioner, the 5th respondent is not true owner of the property in S.No.1672/5 and hence, he has no right over the same. Hence, the petitioner has approached this Court.
3. Heard the submissions of the learned counsel appearing for the 5th respondent and the learned Special Government Pleader appearing for the respondents 1 to 4.
4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the matter, this Court directs the 2nd respondent to consider and dispose of the application of the petitioner dated 05.07.2024 and pass orders on merits and in 3/6
accordance with law, after issuing notice to the petitioner and the 5th respondent, within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
