Respondents PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Courts Act, 1971, praying to initiate proceedings against the respondents for willful and contumacious disobedience of direction passed by this Court in the order made in W.P.(MD)No.12355 of 2022 dated 20.06.2022 and prosecute and punish the respondents for the contempt of court for flouting the above said order of this Court.

[Order of the Court was made by M.S.RAMESH, J.] Alleging willful disobedience of the order passed by this Court in W.P. (MD)No.12355 of 2022 dated 20.06.2022, this Contempt Petition has been filed.

2.Since the respondents have issued the eviction order under Section 6 of the Tamil Nadu Land Encroachments Act, 1905, on 09.01.2025, we are of the view that effective steps have been taken for removal of the encroachments. As such the disobedience alleged cannot be termed as wilful in nature. Accordingly, the contempt petition is closed. [M.S.R., J.] & [A.D.M.C., J.] 24.01.2025 NCC :
