PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.175 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police 1/3

for the offences punishable under Order 6(2) and 6(4) of the Tamil Nadu Scheduled Commodities (RDCS) order 1992 and Section 7(1)(A) of the Essential Commodities Act, 1955 in Crime No.175 of 2023, seek anticipatory bail. 2.The case of the prosecution is that on 06.11.2023, at about 07.00 am., one TATA 407 vehicle bearing Reg.No.TN 74 B 3855 standing in front of the ration shop with loaded 60 gunny bags of PDS rice, each contains 50 kgs, total weight is 3000 kgs. On enquiry it reveals that A1 with the help of A2 smuggled PDS rice from the ration shop. Hence, the case.

3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. 4.The learned Additional Public Prosecutor appearing for the respondent Police would submit that the first petitioner herein is the employee of the fair price shop and the second petitioner is her husband. He would further submit that the key of the fair price shop is with the first petitioner and she helped the other accused to commit the offence. Hence, he strongly objected to grant anticipatory bail to the petitioners.

5.On perusal of records, it is noticed that the first petitioner herein is the sales woman of the fair price shop and she and her husband actively involved in the offence. Therefore, this Court finds no ground to grant anticipatory bail to the petitioners.
