PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records on the file of the respondents passed the impugned rejection order of Sub-Division in the petitioner's application No.2025/0105/34/345271 dated 17.06.2025 and quash the same as illegal and arbitrary and consequently the respondents to rectify the FMB Sketch and Sub Divide petitioner's land in Survey No.1381/30A1A to extent of 11 cents at Madathupatti, Kadayanallur Taluk, Tenkasi District within the time limit that may be stipulated by this court. 1/4

ORDER

The petitioner had applied for sub divisional patta which was rejected by an order dated 17.06.2025. Such rejection order states that there is a discrepancy between the extent indicated in the petitioner's request and sale deed in comparison to the land available in the relevant survey number. 2.Learned counsel for the petitioner submits that this is only on account of an error in the FMB sketch in as much as it shows 8 metres on the southern side instead of 12.2 metres. This aspect can only be ascertained by conducting a survey.

3.Learned Additional Government Pleader accepts notice on behalf of both the respondents. He submits that survey would be conducted as a first step to ascertain whether the contentions of the petitioner are correct. Thereafter, he states that the petitioner's request would be reconsidered. 2/4

4.Accordingly, this writ petition is disposed of with the following directions:- a)The petitioner is directed to submit an online application with requisite fees for the conduct of a survey of the land in S.No.1381/301A. Such application shall be submitted within one week from the date of receipt of a copy of this order;

b)Upon receipt of such application, the second respondent is directed to undertake and complete the survey within eight weeks from the date of receipt of such application; and c)If the results of the survey show that the petitioner's contention with regard to the error in the FMB sketch is correct, the petitioner's request for subdivisional patta shall be reconsidered without reference to the impugned order.

5.The writ petition is disposed of on these terms. No costs. Consequently, connected miscellaneous petition is also closed. 19.09.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
