PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to conduct an enquiry regarding sale deed in Document No.776/1990 dated 01.10.1990 registered in favour of the 4th respondent and subsequent sale deed in Document No.2495/2007, dated 16.11.2007 on the file of the 3rd respondent registered in favour of the 5th respondent by considering the petitioner's representation dated 13.09.2022 within the time stipulated by this Court. ORDER

Heard the learned counsel on either side.

2.The petitioner wants the respondents to consider his representation for cancelling the petition mentioned documents that were registered in the year 1990 and 2007. The relief sought for cannot be granted for two reasons. During the relevant year, there was no circular 2/5

or statutory provision in operation enabling the registering authority to cancel the registered document. The petitioner cannot therefore take advantage of the subsequently issued circular or amended legal provision. Such circulars will not operate retrospectively. 3.Leaving open all the contentions and defences of the petitioner, this writ petition is disposed of. No costs.
