ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the second respondent not to harass the petitioner to hand over the JCB without following due process of law.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondents would submit that on the basis of the complaint given by one Sagayam, the petitioner was summoned to appear before the second respondent, but he has not turned up. He would further submit that the petitioner has contacted the second respondent through phone and informed him that he would appear on 31.12.2022, but he has not turned up.

3. At this juncture, the learned counsel appearing for the petitioner would submit that the petitioner is ready to appear before the second respondent.

4. Recording the submissions made on either sides, the petitioner is directed to appear before the second respondent and on such appearance, the second respondent is directed to proceed with the enquiry in accordance with law.

5. With the above directions, this Criminal Original Petition stands disposed of.
