Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondent to issue separate patta in the petitioner's name for his agricultural land to an extent of 80 cents situated in Survey No.792/2A1A (Old Survey No.792/2A1) at Nallamannaickarpatti Village, Rajapalayam Taluk, Virudhunagar District, purchased vide doc.No.3610/2005, dated 28.09.2005, on the file of the SubRegistrar, Rajapalayam, based on the petitioner's representation, dated 02.09.2022.

ORDER

The petitioner herein seeks a direction to the respondent to issue separate patta in his name in respect of the property situated in Survey No. 792/2A1A (Old Survey No.792/2A1) to an extent of 80 cents in Nallamannaickarpatti Village, Rajapalayam Taluk, Virudhunagar District, by considering his representation, dated 02.09.2022.

According to the petitioner, the above mentioned property was purchased by him under a registered sale deed, dated 28.09.2005, from one Chinnaraj, and, based on the said document, he submitted a representation to the respondent on 02.09.2022, seeking for mutation of revenue records in his favour. The said representation has not been considered. Hence, the petitioner has come before this Court.

3. Learned Government Advocate, appearing for the respondent, would submit that if the petitioner produces registered documents from the year 1966 and other necessary documents to substantiate his claim over the property, his representation will be considered on its own merits

4. In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to submit all the documents in his custody in support of his claim for mutation of revenue records before the respondent within a period of four weeks from the date of receipt of copy of this order. The respondent shall consider the representation of the petitioner, dated 02.09.2022, and pass final orders on its own merits within a further period of eight weeks, thereafter.

5. Writ Petition is disposed of accordingly. No costs. 11.06.2025 NCC :
