ORDER
This writ petition has been filed seeking issuance of a Writ of Mandamus to forbear the 1st respondent from disbursing the amounts standing in the name of Late Mrs.Mary Thayammal in Savings Bank Account No. 67035943197, Fixed Deposit Nos. 41786083023, 417860888204, 41786172470, 42297074141 and 43438246063, and from operating the locker facility, in favour of the 2nd respondent; and consequently to direct the 1st respondent to disburse the said amounts in favour of the petitioner within a time to be stipulated by this Court.
2. It is informed that there are several Class-II legal heirs of Late Mrs. Mary Thayammal and her husband. Therefore, the petitioner must first establish his rights by initiating appropriate proceedings before the competent civil court and have the rights of the parties adjudicated.
3. Till such adjudication is made and the civil court renders its judgment, the 1st respondent Bank shall keep the aforesaid accounts and 2/4
the locker facility frozen. In the proceedings to be instituted, the 2nd respondent shall also be impleaded as a party.
