ORDER

This Criminal Original Petition has been filed to quash the First Information Report registered in Crime No.302 of 2025 on the file of the first respondent Police Station.

2. The allegation in the FIR is that the defacto complainant is a lessee in a shop, which belonged to a temple; and that the petitioners removed the shutter of the shop and committed theft of several articles worth about Rs.33,000/- and thus, committed the aforesaid offences.

3. The learned counsel for the petitioner/A2 would submit that the allegations in the FIR are false; that the said property belongs to the petitioner; that no specific overt act is attributed to him; and that since the first accused belongs to a political party, in which, the petitioner is also a member, he has been falsely made an accused.

4. The points raised by the learned counsel for the petitioner is factual in nature and it cannot be adjudicated in the quash petition. However, the first respondent is directed to conduct the investigation in Crime No.302 of 2025 and file the Final Report as expeditiously as possible. 2/4

5. With the above direction, this Criminal Original Petition is disposed of.
