ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. B. Rajesh Saravanan, Advocate for the Petitioner and of Mr. K. Appadurai, Advocate for the 1st respondent, this Court made the following order: 'This Civil Miscellaneous Petition has been filed to set aside the dismissal order, dated 07.06.2023 and restore the appeal in C.M.A(MD)No.502 of 2023 and permit the appellant to proceed with this appeal. 2.Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.

3.It is evident from the records that the petitioner's earlier application in CMP(MD)No.1894 of 2025, to condone the delay of 507 days in filing the restoration petition was allowed on 17.06.2025. The present Civil Miscellaneous Petition is filed seeking restoration of the appeal in C.M.A.(MD)No.502 of 2023, which was dismissed for default on 07.06.2023.

4.Considering the reasons assigned, this Court is inclined to allow this petition. Accordingly, this Civil Miscellaneous Petition is allowed.
