PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to call for the records relating to FIR in Crime No.1121 of 2020 dated 17.05.2020 on the file of the Respondent Police Station and quash the same.

O R D E R

The learned Counsel for the Petitioner submits that the Petitioner had filed this Criminal Original Petition seeking to quash the FIR in Crime No. 1121 of 2020 pending on the file of the Respondent. It is his further submission that the Petitioner is arrayed as A11 in Crime No.1121 of 2021. The offences are under Sections 188, 269 and 270 IPC and Sections 8 and 9 of Tamil Nadu Gaming Act, 1930. He would further submit that the facts of the case are exactly similar to the case covered in the decision reported in 2018 2 LW (Crl) 606 [Jeevanandham and others vs. The Inspector of Police Velayuthampalayam Police Station, Karur District] dated 20.09.2018.

2.The learned Government Advocate (Crl.side), on instructions of the Respondent, would submit that the investigation had been completed and final report will be filed quickly.

3.The submission of the learned Government Advocate (Crl.side) cannot at all be accepted, considering the fact that the facts of this case are similar to the facts covered by the Judgment of this Court reported in 2018 2/4

2 LW (Crl) 606 [Jeevanandham and others vs. The Inspector of Police Velayuthampalayam Police Station, Karur District] dated 20.09.2018. 4.Accordingly, this Criminal Original Petition is allowed. The FIR in Crime No.1121 of 2020 on the file of the Respondent is hereby quashed as far as the Petitioner is concerned. Consequently, connected Miscellaneous Petition is closed.
